THIS JUST IN FROM THE ONEONTA POLICE DEPARTMENT!

On October 16, 2014 at about 9:30 PM the City of Oneonta Police Department responded to Smokers Choice at 76 Chestnut St Oneonta N.Y. for a reported armed robbery in progress and the suspect was being restrained by a customer. Upon arrival Sgt. Pajerski, Ptl. Gallusser, Ptl. Pondolfino and Lt. Brenner discovered a man wearing a ski mask being held on the floor by another man. The man with the ski mask was taken into custody and identified as Joseph A. Cardo, 34 years old from Oneonta NY. A black handgun was also recovered.

The results of the investigation revealed that the suspect, Joseph A Cardo entered the Smokers Choice Store wearing a ski mask, approached the counter displayed a black hand gun and demanded money from the register. A customer who was standing next to the counter grabbed the handgun and subdued Joseph A. Cardo while the police were called. The handgun used was an all-black Daisy pellet pistol commonly called a BB gun.

No injuries were reported and nothing was taken during the robbery attempt. Joseph A. Cardo was charged with Attempted Robbery in the first degree, a class B Felony, Criminal Use of a Firearm in the second degree, a class C Felony, and Menacing in the first degree a class E Felony. Joseph A. Cardo was arraigned in the City of Oneonta Court and remanded to the Otsego County Correctional Facility under $30,000 cash bail, $60,000 bond to appear at a later date.

The charge of Attempted Robbery in the first degree carries a maximum sentence of 25 years imprisonment
The charge of Criminal Use of a Firearm in the second degree carries a maximum sentence of 15 years imprisonment
The charge of Menacing in the first degree carries a maximum sentence of 4 years incarceration.
