The warrant used to convict John Gavazzi of Greene on possession of child pornography has been thrown out by New York’s highest court.

In obtaining the warrant a state trooper typed "local criminal court, Town of Broome, Broome County." It should have read, "Town of Greene Chenango County."

The warrant was signed by the village justice without correcting it. The New York Court of Appeals threw out the warrant on grounds that the signature was illegible, the village court is not named, there was no seal, and the caption typed by the trooper refers to a non-existent town.
