Authorities in Delaware County are investigating allegations against the patient of an extended care facility accusing the elderly man of sexual misconduct.

According to a news release issued by Delaware County Sheriff Craig DuMond’s office on December 5, a patient at the Delhi Rehabilitation Center is accused of molesting a staff member and a resident.

Delaware County Sheriff’s officials say they received a complaint from the Delhi Rehabilitation Center alleging there had been unwanted sexual contact between residents at the facility.

Authorities say during the course of their investigation, it was discovered that 70-year-old Charles David of Delhi reportedly subjected two victims to unwanted contact.

David was arrested on Wednesday, November 30 and charged with two counts of Forcible Touching, a Class A Misdemeanor under New York State Penal Law.

David is accused of subjecting two females to unwanted sexual contact on two separate occasions while at living at the facility on State Highway 10 in the Town of Delhi.

David was issued a criminal summons for Town of Delhi Court at a later date.

An order or protection was issued prohibiting the man from having any contact with the victims.

The charges are only allegations and the subject is not guilty until convicted in a court of law.

The news release did not indicate whether or not the 70-year-old was still living at the Delhi Rehabilitation Center or had moved out of the facility.

If convicted of Misdemeanor Forcible Touching, David could face a maximum sentence of up to one year in jail.  First time offenders are often spared jail time and may be sentenced to six years probation.

According to NY Penal Code 130.52, a person is guilty of forcible touching when such person intentionally, and for no legitimate purpose, forcibly touches the sexual or other intimate parts of another person for the purpose of degrading or abusing such person; or for the purpose of gratifying the actor’s sexual desire.
