A state audit has raised questions about the procedure used to hire a law firm that looked into problems with the Binghamton University men's basketball program.

Comptroller Thomas DiNapoli Monday released a report that examined the payment of $913,500 for the investigation conducted by Judith Kaye and others affiliated with the Skadden, Arps law firm.

The audit noted the deal was reached and the work was performed before justification was made for a single-source contract.

Kaye, a retired chief judge with the New York State Court of Appeals, released a 99-page report in February 2010. The document included findings of the review of the troubled Binghamton University men's basketball program.

DiNapoli says auditors with his office uncovered cases of abuse of taxpayers money at the SUNY Research Foundation.

The comptroller has announced a new audit of how the foundation charges SUNY schools for overhead costs.

DiNapoli says the Research Foundation should improve its internal controls and fundamentally change the way it operates.
