
Massive ZYN Tax Starts September 1 in New York State
Leave it to New York State to start taxing something new so they can get their hands in the pot. New York State will now heavily tax the popular chewing tobacco product at ZYN and similar products starting on September 1st 2026.
ZYN has taken off in popularity over the past few years as a substitute for smoking cigarettes. In fact, ZYN and vapes have risen to extreme popularity and people under the age of 30.
New York State will start a 75% wholesale tax starting on September 1, 2026. What does this mean if you are a ZYN user.
Any of the alternative nicotine products, just like ZYN are subject to this massive tax rate, but that does not mean that you are going to see a price and then a 75% tax on top of that--not on paper anyway. The wholesaler is going to get the brunt of all of the tax and of course, one would assume that the price increase will soon come to the consumer.
Retailers and wholesalers had to inventory their stock and submit it to New York State so that new inventory coming in starting on September 1 can start being taxed.
Of course, the tax rate does not applied to products sold on Reservations in New York State. According to the New York State website on Taxation:
The tax is imposed at the rate of 75% of the wholesale price of the product and is generally paid by the distributor. However, wholesale dealers and retail dealers selling alternative nicotine products are liable for the tax on these products in their possession if the tax has not been paid by a distributor.
Registration requirements: By September 1, 2026, distributors, wholesale dealers, and retail dealers that currently import or sell alternative nicotine products in New York State must obtain a license or registration to sell tobacco products unless they are already licensed or registered with the Tax Department to sell tobacco products.
ZYN and other alternate nicotine products are not the first popular product to be taxed as flavored vapes have started to be taxed in New York State heavily.
